Terms of Service

The short version.
- Alea is an educational tool. It helps you learn, but it does not guarantee any grade, score, or result, and it is not professional advice.
- Parts of Alea are powered by AI. AI answers can be wrong or incomplete — please verify anything important.
- You must be 18 to open your own account. Children use Alea only through a parent, guardian, or school who agrees to these terms on their behalf.
- The Service is provided “as is”, our liability is limited, and these terms are governed by the law of India (Pune, Maharashtra).
1. Acceptance of these terms
These Terms of Service (the “Terms”) are a binding agreement between you and the operator of Alea Learning (“Alea”, “we”, “us”, “our”) governing your use of alealearning.com and the Alea applications (together, the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. Who we are
Alea is an educational service currently operated by an individual (the “operator of Alea Learning”); the business is not yet incorporated. References to “Alea”, “we”, or “us” mean that operator.
3. Eligibility and accounts
- You must be at least 18 years old to create your own account.
- A person under 18 may use the Service only through an account set up and supervised by a parent, guardian, or a teacher or school acting under its own authority. If you set up or supervise a child’s use, you do so on their behalf, you are responsible for their use of the Service, and you accept these Terms for both yourself and the child.
- You agree that the information you provide is accurate, and you will keep your login credentials secure. You are responsible for all activity under your account.
- Teachers, educators, and schools represent that they have the authority and any necessary consents to add and manage their students.
4. What Alea does
Alea provides AI-assisted, adaptive learning across subjects, including lessons, practice, diagnostics, a conversational AI tutor (in text and voice), progress tracking, and an optional “Talk to a Teacher” live-support feature. The Service is provided for general educational purposes.
5. Educational service only; no guarantee of outcomes
Alea is a learning tool. It is not professional, academic, legal, medical, financial, or other expert advice, and it is not a tutoring credential, certification, or examination authority. We do not guarantee any particular learning outcome, grade, test score, admission, or result. You are responsible for how you use what you learn.
6. AI-generated content
Parts of the Service, including the tutor, are powered by automated AI systems. AI-generated content may be inaccurate, incomplete, out of date, or otherwise unreliable, and it is generally not reviewed by a human before you see it. Do not rely on AI output as a sole source of truth, and independently verify anything important. You use AI features at your own risk, and, to the extent permitted by law, we are not liable for actions taken in reliance on AI output (see Sections 13 to 15).
7. “Talk to a Teacher” live support
The optional live-video support feature connects a learner with a member of our team for help with the Service. It is for in-platform learning support only. It is not an emergency, counseling, medical, or crisis service; if you need urgent help, contact the appropriate local emergency or professional service. Calls are not recorded. You agree to behave appropriately during a call, and we may end a call at any time. The feature may be unavailable, and we do not promise a response within any particular time.
8. Acceptable use
You agree not to:
- use the Service unlawfully or in violation of these Terms;
- misrepresent your identity or age, or access another person’s account;
- upload or transmit content that is unlawful, harmful, abusive, hateful, sexually explicit, or that exploits or endangers a minor;
- harass, abuse, or threaten our team during support;
- attempt to disrupt, overload, reverse engineer, scrape, or circumvent the security or access controls of the Service;
- use the Service to build a competing product or to train other AI models; or
- use automated means to access the Service except as expressly permitted.
We may investigate and take action, including suspension or termination, for any violation of this section.
9. Your content and license
You retain ownership of the content you submit — for example, your questions, answers, notes, and uploads (“User Content”). You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, and display your User Content for the purpose of operating, securing, and improving the Service and providing it to you and, where applicable, to the educator or guardian responsible for the account. You represent that you have the rights necessary to submit your User Content and that it does not violate these Terms or any law.
10. Our intellectual property
The Service — including its curriculum, software, design, text, graphics, and the “Alea” name and logo — is owned by us or our licensors and is protected by intellectual-property laws. We grant you a limited, personal, non-transferable, revocable license to use the Service for its intended educational purpose. You may not copy, modify, distribute, sell, or create derivative works from any part of the Service except as expressly permitted.
11. Payments, subscriptions, and refunds
Some features require a paid subscription. Prices are shown in the Service and may vary by region and currency. Payments are processed by our third-party payment processor (Razorpay), and you agree to its terms. Paid subscriptions renew automatically for successive billing periods until cancelled; you can cancel before the next renewal to stop future charges. Unless required by law, payments are non-refundable, and cancelling does not entitle you to a refund for the current period. We may change prices on a forward-looking basis; changes will not affect a period you have already paid for. You are responsible for any applicable taxes.
12. Third-party services
The Service relies on third-party providers (described in our Privacy Policy). We are not responsible for the availability, acts, or omissions of those providers, and your use of features that depend on them may be subject to their terms.
13. Disclaimer of warranties
The Service is provided “AS IS” and “AS AVAILABLE”, without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, and any warranties arising from course of dealing or usage. We do not warrant that the Service will be uninterrupted, secure, error-free, or that any content (including AI output) will be accurate or reliable. Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you.
14. Limitation of liability
To the maximum extent permitted by law, the operator of Alea Learning will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) the Service, including any reliance on AI output, even if we have been advised of the possibility of such damages.
To the maximum extent permitted by law, our total aggregate liability for all claims relating to the Service will not exceed the greater of (a) the total amount you paid us for the Service in the three (3) months before the event giving rise to the claim, or (b) INR 1,000. These limits apply regardless of the legal theory and form an essential basis of our agreement with you.
15. Indemnification
You agree to indemnify, defend, and hold harmless the operator of Alea Learning from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your User Content, your violation of these Terms, your violation of any law or third-party right, or, where you supervise a child’s use, that child’s use of the Service.
16. Suspension and termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access at any time, with or without notice, if we believe you have violated these Terms or to protect the Service, our users, or others. Sections that by their nature should survive termination (including Sections 9 to 15 and 17 to 19) will survive.
17. Changes to the Service and these Terms
We may change, suspend, or discontinue any part of the Service at any time. We may also update these Terms; if we make material changes, we will update the “Last updated” date and, where appropriate, provide additional notice. Your continued use of the Service after a change means you accept the updated Terms.
18. Governing law and jurisdiction
These Terms are governed by the laws of India, without regard to conflict-of-laws principles. You and we agree to the exclusive jurisdiction of the courts located in Pune, Maharashtra, India for any dispute arising out of or relating to these Terms or the Service. Before filing a claim, you agree to first contact us at hello@alealearning.com and attempt in good faith to resolve the matter informally.
19. General
These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service and supersede any prior agreements. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them, including to a future incorporated entity that operates Alea. Nothing in these Terms creates a partnership, agency, or employment relationship between you and us.
